TERMS AND CONDITIONS & WAIVER AND RELEASE OF LIABILITY

Welcome to Alpine Performance Labs, Inc. ("APL"). The www.apl.training website (the "Site") is composed of various web pages operated by APL. www.apl.training is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.apl.training constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.


APL is a hybrid training business providing both in-person and remote strength and conditioning coaching for mountain athletes, recreational sports enthusiasts, and outdoor adventurers. Our services include personalized coaching, semi-private training, digital training programs, community events, and seasonal performance initiatives.


Privacy
Your use of the Site is subject to APL's Privacy Policy, which is incorporated by reference into this agreement. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.


Electronic Communications
Visiting www.apl.training or sending emails to APL constitutes electronic communications. You consent to receive communications electronically and agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email or on the Site, satisfy any legal requirement that such communications be in writing.


Your Account
If you create an account on this Site or with our training platforms (e.g., Everfit, Stripe, etc.), you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your devices. You accept responsibility for all activities that occur under your account. APL is not responsible for third-party access to your account resulting from theft or misappropriation. Any violation of these Terms or our Privacy Policy may result in termination of services at our sole discretion.


Youth Policy
APL does not knowingly collect personal information from individuals under the age of 18 without parental or guardian consent. If you are under 18, you may use APL services only with permission and supervision of a parent or guardian.


Cancellation & Refund Policy
Monthly training subscriptions and session packages are billed through our payment processing systems and are non-refundable once the transaction is completed. All memberships require a 10-day written notice prior to the next billing cycle to terminate auto-renewal.


Remote and in-person training sessions require a 12-hour cancellation notice. Late cancellations may be subject to a fee. APL reserves the right to waive cancellation fees at its discretion in the event of emergencies or extenuating circumstances.


Third-Party Services & Links
APL may integrate services from platforms used for scheduling, billing, training delivery, and communication. We are not responsible for the privacy or data practices of these platforms. It is your responsibility to review the privacy policies and terms of use of those third-party services.


Intellectual Property
All content included as part of APL's services (e.g., text, graphics, logos, training materials) is the property of APL or its licensors and is protected by applicable intellectual property laws. You may not reproduce, publish, or distribute any materials without express written permission from APL.


International Use
Our services are based in the United States and operated under U.S. law. If you access APL services from outside the U.S., you are responsible for compliance with local laws.


Indemnification
You agree to indemnify, defend, and hold harmless APL, its owners, employees, agents, and affiliates from any claims, liabilities, costs, or damages resulting from your use of our services or any violation of these Terms.


Arbitration & Governing Law
In the event of a dispute, the matter will be resolved through binding arbitration under the Federal Arbitration Act, governed by Colorado law. Arbitration shall occur in a mutually agreed upon location in Colorado. Each party shall bear their own costs unless otherwise determined by the arbitrator. This agreement to arbitrate shall survive the termination of services.


Liability Disclaimer
APL provides training and information on an "as-is" basis without warranties of any kind. We do not guarantee results or outcomes. By participating in our services, you acknowledge the risks associated with physical exercise and voluntarily assume responsibility for those risks.


Termination of Access
APL reserves the right to terminate your access to services or the Site at any time without notice for violations of these Terms.


WAIVER AND RELEASE OF LIABILITY


In consideration of the opportunity to participate in training with Alpine Performance Labs, Inc., I acknowledge and agree to the following:


I understand that participation in physical exercise involves inherent risks, including but not limited to injury, illness, muscle strain, falls, and other accidents. I voluntarily assume all risks.


I release APL, its owners, employees, and affiliates from any claims or liabilities related to injury or harm resulting from my participation in training, whether in-person or remote.


I understand that any use of APL’s facilities or equipment (including barbell lifting, cardio machines, plyometrics, and outdoor training) is at my own risk.


If pregnant or managing a medical condition, I will consult with a physician before engaging in training and assume responsibility for any associated risks.


I grant APL permission to use video, photo, or recorded materials of me for promotional purposes unless otherwise stated in writing.


If under the age of 18, I confirm that this waiver is signed by a parent or guardian.


I have read this agreement, understand its terms, and sign it voluntarily. This waiver is binding upon me, my heirs, legal representatives, and assigns.
